Suit Filed By Parents of California University Student In Hazing Death

The parents of a California State University, Fresno freshman who died in 2012 of alcohol poising while pledging for a fraternity have filed a wrongful death suit against the fraternity and several of its members.
Paul and Diane Dhanens, parents of 18-year-old Philip Dhanens of Bakersfield, filed the suit against the Indiana-based Theta Chi Fraternity Inc., the local Beta Upsilon chapter, and six members of the fraternity. The suit was announced Friday by San Francisco-based law firm Kerr Wagstaffe.
Three Fresno State students were charged last week with hazing and providing alcohol to Dhanens, who was only a couple weeks into his first semester when he died.
The coroner’s office found that he had a blood-alcohol level of 0.36, nearly five times the legal driving limit.

Toyota’s sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn’t the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn’t plan on settling on all of them as it still wants to be able to “defend [its] product at trial.” This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

Family Of Girl Killed In Crash With New Mexico Doctor Sues

The family of a little girl killed when her family’s van was hit by a vehicle driven by a Santa Fe, New Mexico surgeon suspected of driving drunk has filed a wrongful death suit against the doctor and her insurance company.
Dr. Deborah Aaron was arrested by Santa Fe police after the Dec. 30 crash that killed 4-year-old Yuliana Aremi Reyes Vasquez. Aaron, 56, has pleaded not guilty to vehicular homicide, but the district attorney has not filed an indictment to move the case forward. She is free on a $100,000 bond.
In court documents, police have said the little girl’s mother wasn’t sure if she had a green light and they have conflicting witness reports.
The Albuquerque Journal reported the lawsuit filed on the family’s behalf on Wednesday flatly says the girl’s mother, Karla Aremi Vasquez Rivera, had the green light when she entered the intersection after first stopping at a red light.
“When she received a green arrow, she initiated a left-hand turn towards the northbound lanes of St. Francis Drive,” the lawsuit states. “As she proceeded across the intersection the minivan was struck by Dr. Aaron’s Range Rover.”
Aaron failed a field sobriety test, smelled of alcohol and had bloodshot, watery eyes, according to an officer’s report. A blood sample later found her blood-alcohol content was 0.08 percent, the level where drivers are presumed to be intoxicated under state law.
Dan Cron, Aaron’s attorney for the vehicular homicide charge, couldn’t be reached for comment Friday.
Police have said one witness told investigators it was the family minivan that ran a red light and that the light was green for Aaron on St. Francis.
