NEW YORK (Reuters) – Convicted hedge fund founder Raj Rajaratnam is in prison, but the jurors of a separate insider trading trial of former Goldman Sachs Group Inc and Procter & Gamble Co board member Rajat Gupta will hear his voice in court on FBI wiretaps. Preliminary ruling: Xbox 360 infringes on some Motorola patents

An ITC ruling has found that the Xbox 360 infringes on four patents owned by Motorola. According to The Verge, some of the patents deal with the H.264 video codec, which is the subject of other legal proceedings between Microsoft and Motorola – with Motorola demanding 2.25% of the final price for any Microsoft product using the standard.
Bloomberg reports that the other two are about Wi-Fi tech, and that a fifth contentious patent was about communication between the Xbox and accessories. One of the Wi-Fi patents was not infringed, and one unspecified claim regarding one of the video patents was “invalid,” judge David Shaw ruled.
In other proceedings related to this issue, Microsoft is seeking to force Motorola to license its “standard” patents on more “fair and reasonable terms.” This preliminary ruling would seem to be a blow towards Microsoft’s effort; however, it is still subject to review by a panel of six judges.

WASHINGTON (Reuters) – Apple Inc infringed on a Motorola Mobility Holdings Inc patent in making its popular iPhones, iPads and other products, a judge for the International Trade Commission ruled on Tuesday. ITC Judge Thomas Pender said in a preliminary ruling that Apple infringed on a patent for eliminating noise and other interference during voice and data transmissions. The full commission will now review the judge’s decision and issue a final ruling in August. …

Potential bad news to start out the week for Microsofties: a judge from the US International Trade Commission has issued a preliminary ruling that finds Microsoft’s Xbox 360 infringes on five of Motorola’s patents. While the decision is by no means final — which means that the Redmond outfit could ultimately prevail — a final ruling would force Microsoft’s hand to seek proper licenses for the technologies, most of which relate to H.264 video encoding, or have its gaming console banned from US shelves. For now, the lawyers will go back to the lab to refine their arguments and get ready to present them to a full panel of ITC judges later this year. Who wants to set odds on the outcome?

ITC preliminary ruling says Motorola’s Droid series doesn’t violate Apple patents

As myriad legal tussles roll on between smartphone manufacturers, Apple’s suffered a knock-back by the International Trade Commission. Apple first lodged its complaint against Moto in October 2010, accusing its Droid family of violating the patents found in its own phones. This was countered by a volley of patent violation complaints from Motorola. Granted, this is still a preliminary ruling, but looks like Motorola may have won this round of legal drudgery.
